1. It is
respectfully submitted that in order to get job opportunities to the students
soon after their passing out from the colleges the second respondent has
forwarded a proposal to the government to establish skill development centers.
After careful examination of the proposal the government accorded
administrative sanction for establishing Jawahar Knowledge Centers (JKCs) in
government degree colleges vide G.O.Rt.No.1010 Dated: 21-12-2005. A method of
recruitment for the post of Mentors on contract basis in the above centers is
also specified under guidelines. To hold the post of Mentor one must have
possessed the qualifications viz., II Class with minimum 55% marks in B.E/B.Tech,
M.Tech, MCA, M.Sc(CS/IT/IS), M.Sc (Maths/Stats/Phy/Chem/Electronics/Geology).
The selection to the said post is consisting of Written Test followed by
Interview under supervision of 3men committee. The Job chart to the said post
is training the JKC students in Computer Skills, Reasoning & Aptitude and
Maintenance of JKC IT & Languages Labs. According to the qualifications and
nature of discharging of duties the post of Mentor is equivalent to the Class –
III post under the service rules like Degree Lecturer. The remuneration also
fixed at Rs.8000/- P.M vide G.O.Rt.No.569 dated: 25-07-2007.
2. We submit
that Commissioner issued a state wise notification inviting the applications
for the post of Mentors on contract basis and accordingly we applied along with
others and we have participated to the subjected the selection process in
accordance with the rules to the post of Mentor an according to our merit we
have been selected to the post of Mentor and at our respective colleges as
shown in the cause title. We have been working as Mentors on contract basis
from the year 2006, 2007, and 2008.
3. We respect to
submit that, after the formation of new state of Telangana, the program is
being followed with a fresh vigor. These JKCs now being called Telangana Skills
& Knowledge Centers (TSKC) have expanded their scope and competencies.
Based on the direction of Hon’ble Chief Minister few more programs have been
introduced to transform Education into a vehicle of change and adaptability of
the students prerequisite skill sets. Introduction of Online courses, 5 Certificate
courses are the program taken up from TSKCs plat form during 2015-16. To
encourage the students in all the Government Degree Colleges, the CCE has
initiated the training program, a mandate course to be transacted in 3 years
for all the students from the academic year 2016-17 with 2 credits. The
curriculum has to be transacted to all students @ of two periods per week and
the students have to work on assignments given.
4. We
respectfully submit that we are being paid only Rs.8000/- P.M. which was fixed
at the time inception of the JKCs Centers with their being any enhancement
though we are discharging duties. We have failed to look at the matter that the
remuneration is very paltry and it needs to be enhanced. At least you ought to
have initiated steps for reviewing the remuneration of the Mentors as we belong
to part and parcel to this department while conducting reviews in respect of
Contact/ Out Sourcing Degree Lecturers from time to time.
5. It is submitted that no review being
conducted for the enhancement of the remuneration as there are several
instances review has been made vide G.O.Ms.No.181 Dated:21-08-2008, G.O.Rt.No.313
Dated:19-05-2011, G.O.Ms.No.14 Dated: 19-02-2016 and G.O.Rt.No.149
Dated:01-06-2017. The periodical reviews are compulsory keeping in view the
cost of living due to steep inflation rates and accordingly reviews have been
made in respect of the Contract/Outsourcing employees for enhancing the
remuneration. Thus the remuneration of Rs.8500/- P.M. is gone to Rs.40270/- P.M
to the Contract Degree College Lecturers now. The following table shows the
comparison between Contract Lecturers, Degree Guest Faculty and Contract TSKC
Full Time Mentors in terms of honorarium.

6. We further
submit that, the commissioner conduct a survey in the year 2014 with regard to
study to evaluate the JKC centers of degree colleges, Centre for Innovations in
Public Systems (CIPS) has taken up this study to identify the problems
confronting the program and suggest suitable recommendations to revive the
program. The Centre for Innovations in Public Systems (CIPS) surveyed recommend
the very low honorarium given to mentors is another major problem confronting
the JKC program. In 2006, when the JKC program was initiated a honorarium norm
for mentors were fixed as 8,000. At the same period, the Contract faculty
working in Government Degree Colleges were paid an honorarium amount of
Rs.8,000/- p.m. (Urban Areas) and Rs.9,500/- p.m. (Rural & Tribal Areas) as
per the orders issued in G.O.Ms.No.181, Higher Education (IE-I/A1) Department,
dated: 21.08.2008. this was revised and further enhanced to a consolidated
remuneration of Rs.20,700/- (Rupees Twenty and seven hundred only) per month
w.e.f. 01.06.2011, without payment of D.A or any other allowances, in terms of
the orders issued in G.O.Ms.No.3, Finance (SMPC-II) Department, dated:
12.01.2011. There is no revision of payment for mentors, lack of competition
for the position, quality of mentors and their motivation levels to function
effectively. Now you are enhanced the remuneration to the Contract Lecturers in
Government Degree Colleges from RS.20,700/- PM. to RS.40,270/-PM but in so far
as our remuneration concern not enhanced. But in our cases of Mentors also have
conducted periodical reviews, but paying only initial fixed remuneration at
Rs.8000/- P.M. from the date of initial appointment i.e. from the year 2007
onwards even after rendering more that 10 years service, which is illegal and
unfair.
7. It
is further submitted that as mentioned above the nature of duties of the Mentor
are similar to that of category post i.e., Degree Lecturer therefore automatically
the Mentors are entitled to the drawn the minimum time scale attached the post
of Degree Lecturer i.e., 40,270/- on the principle of “Equal Pay for Equal
work” guaranteed under Article 39(d) of the Constitution of the India as held
by the Hon’ble Apex Court in Jagit Singh’s Case. We further submitted that we
are entitled to grant minimum time scale attached to the post held by us in
terms of judgment in Civil Appeal No.213 of 2013 (State of Punjab & others
Vs. Jagit Sing and others) and also in
another case Ram Naresh Rawat Vs. Ashwini Ray and others. It is further submitted that the pay attached
to the post of Degree Lecturer in the Revised Pay Scales, 2015 in terms of
G.O.Ms.No.46 Fin dt.30-04-2015 is Rs 40,270/ for which we are entitled to be
granted together with allowances as applicable.

It is further submitted that a representation is made through association time again
for enhancement of the remuneration including on 22.01.2018 to the commissioner.
It is surprising to note that even after receipt of our representation a review
of enhancement of remuneration from Rs.100 to Rs.300 Per hour was made by your
authority in respect of guest faculty vide G.O.Rt.No.54 Dated: 23-03-2018. We
approached the Hon’ble High Court vide W.P.No14307/2018 and the Hon’ble High
Court allowed the Writ petition with a direction to us to make a individual
representations ventilating their grievances. It is also found that the
Government of Telangana vide G.O.Rt.No.149 Higher Education (CE) Department,
dt.01.06.2017 has enhanced the remuneration of the Contract Lecturers working
in Government Degree Colleges in the State to Rs.40,270-93,780/-. And further
directed to make a individual applications to the competent authority and the
competent authority is directed to consider the same and take action in terms
of G.O.Rt.No.149 dt.01.06.2017 within a period of four weeks from the date of
receipt of a copy of this order.
Therefore we
prayed your kind authority to enhance the salary/remuneration to the post of
Mentor as it is equivalent to the Degree Lecturer appropriately by conducting
review and fix appropriately to that of 40,270/-P.M vide G.O.Rt.No.149
